Terms & Conditions

Contract

A booking is made between ChamServe Limited, (hereinafter called Chamonix Holidays) and the named person, (hereinafter called 'group leader') who has confirmed the booking and accepted the Terms and Conditions on the website, and when payment of deposit has been received and cleared.

The group leader is responsible on behalf of all other members of the group for all matters relating to the booking.

'Group' refers to all persons booked to stay in the accommodation. The group includes any change of names to the original booking.

Chamonix Holidays guarantees the price of the holiday as quoted at the time of booking.

Chamonix Holidays reserves the right to increase or decrease the price of unsold holidays at any time.

Chamonix Holidays reserves the right to terminate without notice and liability the holiday of any group member and risk that of the entire group whose behaviour is such that it is likely to disrupt the enjoyment of others on holiday or staying in the building, or cause damage to the property or any third party.  You are also liable to forfeit your cautionary deposit if we receive complaints from our neighbours or from our building management agent regarding the group’s unruly behaviour. This is entirely at the discretion of Chamonix Holidays.

Terms Payment

First Instalment: Upon reservation, the group must pay a deposit or first instalment of 30% of the price of the accommodation within 7 days, or full payment if the booking is made within 10 weeks prior to arrival.  This first instalment ensures the reservation of the accommodation for the period of your requested stay, until the contract is made.

Should you cancel your reservation or contract at any time, your first instalment will not be refunded.

Final Payment: The group undertakes to make the final payment of 70% of the price of the accommodation no later than 8 weeks prior to arrival.  If payment is not received by the due date Chamonix Holidays reserves the right to cancel the arrangements without further notice or reference to the client, first instalments being forfeited and the normal cancellation charges apply.

Payment can be made by bank transfer, cheque, debit or credit card. If payment is made by debit or credit card, a 2.85% handling fee per transaction will be charged and automatically added to your balance. Any charges levied by Chamonix Holidays’s bank for foreign transfers or cheque payments are at the cost to the group.

Cautionary deposit: A returnable cautionary deposit equivalent to GBP 100 multiplied by the normal sleeping capacity of the accommodation booked is taken at the time of full or final payment, or on arrival as a deferred credit card payment.  This payment will be returned within 2 weeks of departure, less any costs incurred for cleaning and damages not reported or paid for. 

It is the responsibility of the group to ensure that the accommodation is left in a clean condition with replacement of all breakages. If you notice anything damaged you must report this within 24hours of arrival. If the group cause any damages, breakages or losses during the booking period the group will be liable for these and will pay for the “like for like” replacement of the damaged/missing items before departure. If the group do not pay and /or the damage is not noticed until after departure and /or items belonging in the accommodation have been removed the group’s cautionary deposit will be used to pay for replacements.  If it is in excess of the cautionary deposit, the group will pay for these within 14 days after departure of the accommodation. 

  • Chamonix Holidays standard administration fee of £30 plus charges are as follows:
  • £30 per hour general cleaning; you are expected to leave it in a reasonable state, this charge applies when you have not made a decent effort to clean up after yourselves.
  • £30 plus the cost of replacement of each key set, remote control, if lost or not returned keys as directed.
  • £30 if rubbish bags are left in the accommodation and not placed in the external communal rubbish bins.
  • £30 if the dishwasher is not emptied or washing not completed with items placed in cupboards where found.
  • £30 if used bed linen and towels (Excluding mattress protectors) are not placed in bath/shower room prior to departure.

£100 if skis/Snowboards/Boots and other related outdoor equipment are stored anywhere other than the designated lockers and storage or worn within the building.

Any costs incurred including legal expenses, involved in Chamonix Holidays collecting any outstanding monies will be paid by the group in addition to the aforementioned.

Alterations

Should the group wish to make any changes to the confirmed booking, the group must notify Chamonix Holidays as soon as possible in writing or by email.  Where an alteration can be accommodated, an amendment fee of £30 may be payable together with any costs incurred by Chamonix Holidays.  No booking can be interchanged with another Chamonix Holidays property, due to different ownerships.

Cancellation by Client

A cancellation must be made in writing and signed by the leader on behalf of the group. If the cancellation is made more than 8 weeks before arrival then the first instalment shall be forfeited. If a cancellation is made within 8 weeks of arrival the following cancellation fees are applicable from the total cost of the holiday 8-4 weeks 50%, 4-2 weeks 75%, 2-0 weeks 100%.

Alteration or Cancellation by Chamonix Holidays

In the unlikely event that Chamonix Holidays has to alter or cancel your accommodation, the group leader shall be notified of any major changes as soon as possible and shall be offered a comparable accommodation or full refund unless the alteration or cancellation is due to forces beyond the control of Chamonix Holidays amounting to Force Majeure.

Force Majeure: Chamonix Holidays does not accept any liability wheresoever or howsoever arising or pay compensation for:

a) any event which Chamonix Holidays could not foresee or avoid. Such events include war, threat of war, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions such as freezing temperatures, lack of snow, and fire, and the like;

b) any cancellation, loss, delay or costs wheresoever or howsoever arising or connected with adverse weather or traffic conditions, avalanche, mud slips, slides and snow conditions and the effect any of these may have on travel arrangements, accommodation and activities, and the like;

c) limitations imposed by resort authorities, ski-lifts, ski school or ski hire operators, and the like;

d) travel arrangements made by the group or on behalf of the group, and the like.

Chamonix Holidays does not accept any liability for personal injury or death wheresoever or howsoever arising caused to any visitor and/or any member of the group for their duration of stay in the accommodation. This is not intended to exclude any statutory rights the group and/or visitor may have. 

Arrival and Departure

Key collection and arrivals are between 4pm and 8pm.  Please note the group may incur charges for late arrival; £20 after 8pm, £50 after 12pm, £100 after 2am.

Departure of accommodation and key drop off and departures are by 10am. (unless otherwise mutually agreed in advance with charges applicable).

Security and Use of the Accommodation

Security in the accommodation will be taken seriously by Chamonix Holidays.  Particular attention should be paid by the group to locking the accommodation at all times. If theft results from unforced entry the group will be liable for any loss suffered in this respect.  All personal items including baggage and equipment are at all times and circumstances at the groups risk and Chamonix Holidays cannot take responsibility for any loss or damage to such items.  Any advise and help given by Chamonix Holidays or their representatives, shall be accepted at the groups risk.  The group undertakes to use the accommodation at their own risk.

Children

The group accept responsibility for the behaviour and welfare of any children in the groups party.  Every effort is made to ensure the safety of the property, but any group taking children on holiday do so at their own risk.

Smoking or Pets

Smoking is not allowed in the accommodation. Pets of all descriptions are banned unless through prior agreement .  Should this be contravened then Chamonix Holidays reserves the right to penalise the group and cancel the group booking without any refund and ask the group to seek alternative accommodation immediately.

Insurance

It is up to the group leader to ensure that each member of the party is responsible for the safety of all their own personal possessions, documents and equipment.  Chamonix Holidays does not accept any responsibility whatsoever for loss or damage to property and or persons or third parties at any time.

It is up to the group leader to ensure that each member of the group has all their own necessary medical and travel insurance documents to cover themselves fully before embarking on the holiday. No responsibility is or will be accepted in respect of any such failure to insure wheresoever or howsoever arising.

Information, Website and Brochure Accuracy

Any information given in the website or by letter or by word of mouth about the resort, accommodation, facilities or services is given in good faith based on the latest information and in the belief that it is true.  Regrettably, errors do occur and descriptions are subjective.  The group leader should therefore check with Chamonix Holidays in advance regarding any feature that is of particular importance to their holiday.

Refunds

No refund will be made for any unused accommodation or additional services. Representatives, chalet girls and agents are not authorised to promise such refunds.

Liability

Chamonix Holidays does not accept liability of any act or default or omission on the part of any suppliers of any service that Chamonix Holidays offers and over whom Chamonix Holidays has no direct control. The group will be bound by the operating conditions of all suppliers of the other services that make up the holiday.

Limitations of Liability

In no event shall the liability of Chamonix Holidays to the group for any loss or damage exceed the price paid for the relevant accommodation or arrangement.

Claims by the group

Any claims or complaints against Chamonix Holidays should be notified to a representative of Chamonix Holidays within 24 hours and any claim or complaint that cannot be resolved in the resort should be made in writing to Chamonix Holidays within 28 days from the end of the booking. A complaint must be made in writing by the person who signed the booking form.

Jurisdiction

Any contract made by the group and Chamonix Holidays shall be governed in all respects by English Law and English Courts only shall have jurisdiction in relation to any claim or dispute arising out of or connected with any such contract.
